Legality of the Electronic Cigarette

Ever since the electronic cigarette came out a few years ago, governments have had mixed reactions to the new device. Due to fears of cheap Chinese imitations and pressure from tobacco companies, some governments have restricted the sales of these devices. Fortunately however, although the FDA in the US have been seizing some imports, electronic cigarettes manufactured locally are perfectly legal to buy, own and use. A summary of countries and the legality is below:

  • In Australia, it is only illegal to sell the liquid nicotine in electronic cigarettes but not the devices themselves
  • In Brazil, the sale, importation and advertising of electronic cigarettes is illegal. The government decided that the current health and safety standards governing electronic cigarettes in Brazil to be inadequate.
  • In Canada, the government banned the importing, selling and advertising of electronic cigarettes in March 2009 due to fears of cheap Chinese imports.
  • In the Netherlands, it is legal to use and sell electronic cigarettes but advertising is not allowed.
  • In Panama, selling and using electronic cigarettes is illegal.
  • In the UK, using and selling electronic cigarettes is perfectly legal.
  • In the US, it is currently perfectly legal to use and smoke electronic cigarettes, however, the FDA are seizing some imports.

Considering the FDA are currently seizing electronic cigarette products, it is important to only buy from trusted American brands such as LUCI.
